Terms & Conditions for PacScan

Welcome to PacScan! These Terms & Conditions ("Terms") govern your access to and use of the PacScan mobile and/or web application ("App"). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. About PacScan

PacScan is a digital service that allows users to scan shipment barcodes, acquire images, register, and organize shipment-related information. Additional features include optional account registration, credit-based functionality, subscription management, and ad-supported access.

2. Acceptance of Terms

By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the App on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

3. Eligibility

You may use the App only if you are legally competent to enter into a binding contract under the laws of your jurisdiction. By using the App, you affirm that you are at least 18 years old or have reached the age of majority in your jurisdiction.

4. Access and License Grant

You are granted a non-exclusive, non-transferable, revocable license to use the App for personal and professional purposes, in accordance with these Terms. This license does not constitute a sale of the App or any part of it.

5. Ownership

The App and all content therein, including but not limited to text, graphics, logos, and software, are the property of the developer or its licensors. You acknowledge that no title or ownership is transferred to you and that you have no rights to the App or its content beyond the limited license provided.

6. Pricing, Subscription, and Ads

PacScan is available free of charge, supported by advertisements provided by Google AdMob. Users may optionally subscribe to a paid plan that removes advertisements and provides additional features. Subscription pricing and terms are displayed within the App and processed via the relevant app store (Apple App Store or Google Play Store).

7. User Accounts

Account registration is optional. Users who register provide an email address, which is used to manage credit allocations and subscription services. All other personal data entered into the app (e.g., shipment records, names, dates of birth) is stored only locally on the device and never transmitted to our servers.

8. Privacy and Data Protection

PacScan respects your privacy. We collect and process limited personal data in accordance with our Privacy Policy. Specifically:

  • Email addresses are processed for account registration and fraud prevention purposes.
  • Subscription identifiers from Apple and Google are processed for subscription verification.
  • Google AdMob may collect device information, advertising identifiers, and approximate location for ad display. We do not control or directly process any ad personalization data.

9. Third-Party Services

PacScan integrates with Google AdMob for advertising purposes. AdMob may collect and process data as described in our Privacy Policy. We are not responsible for the privacy practices of third-party services.

10. Acceptable Use Policy

By using the App, you agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law;
  • Harass, threaten, or defraud other users;
  • Interfere with or disrupt the operation of the App;
  • Attempt to gain unauthorized access to the App or its systems;
  • Reverse engineer, decompile, or disassemble any part of the App.

11. Maintenance and Support

The developer is solely responsible for providing maintenance and support services for the App. Apple and Google have no obligation to furnish any such services.

12. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind. Use it at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, the developer shall not be liable for any damages resulting from the use or inability to use the App.

14. Termination of License

This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of these Terms. Upon termination, you must cease all use of the App and destroy all copies.

15. Apple and Google as Third-Party Beneficiaries

You acknowledge and agree that Apple and Google are third-party beneficiaries of this agreement and that they have the right to enforce these Terms against you as third-party beneficiaries.

16. Modifications to the Terms

We may update these Terms at any time. Changes will be posted on the website. Continued use of the App after changes indicates acceptance.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of Italian courts.
